Background Information: Under the Obama administration, immigrants whose only violation was being in the country illegally were generally left alone, as the focus then was on immigrants who had been convicted of serious crimes or were considered threats to national security. Families that were caught crossing into the US illegally during this time were either deported to Mexico or housed together in detention facilities pending a hearing, since many came from Central America and had legitimate claims of asylum from gang violence. Once a federal court told them they could not do that due to existing laws about housing illegal immigrant children, the Obama administration released them on parole, something that has been referred to as “catch and release.” On February 21st, 2017 the Trump administration announced sweeping new crackdowns on people living in the United States illegally. Department of Homeland Security memos called for any illegal immigrant charged, convicted or even suspected of a crime – including people arrested for minor offenses, such as shoplifting or traffic violations – to become an enforcement priority. All immigrant families caught illegally crossing into the United States were now being charged with federal crimes, and children were thus necessarily separated when their parents go to jail. In May 2018, the ACLU reported on pervasive abuse and neglect of unaccompanied immigrant children detained by U.S. Customs and Border Protection. The issue remains controversial. Although globalization has created demand for a global labor market, many Americans feel we would be rewarding lawbreakers by providing them a path to citizenship. Others view immigrants as a net positive for our country, citing how making them legal could help contribute tax revenue. Furthermore, many believe they should not be treated as criminals and that it is inhumane to separate families at the border. Grading Rubric Used in this
